ACCC Pop Up Dialogue - Application Issues Under D&O Insurance Policies: Rescission and Practical Dilemmas

Claims-made-and-reported policies can catch an insured “coming and going” regarding  potential claims. Inadequate disclosures in an insured’s application for new coverage with a different carrier can result in claim denial or policy rescission if the insured should have disclosed circumstances that later become a claim under the new policy. If, on the other hand, that potential claim is not reported under the expiring policy, then the insured risks losing coverage under both the expiring policy and the new policy.  Our panel will discuss relevant case law, alternative policy language, and the equities involved on both sides of these issues.
