In Monroe Guaranty Ins. Co. v. BITCO General Ins. Corp. Inc., No. 21-0232 (Tex. Feb. 11, 2022), the Texas Supreme Court finally addressed whether Texas recognizes an extrinsic evidence exception to the complaint allegation rule and, if so, the scope of the exception.  Modifying the Fifth Circuit’s Erie guess from almost two decades ago, in Northfield Ins. Co. v. Loving Home Care, Inc., 363 F.3d 523 (5th Cir. 2004), the Court acknowledged a limited exception, for “coverage-only” facts that conclusively determine coverage.  Join us for a discussion of the Court’s opinion, what it does and doesn’t resolve, and where litigation is likely in the future.
