An ACCC Dialogue: When Is A Former Client Relationship A Disqualifying Conflict?

This Pop Up call is going to address the issue of conflicts and, in particular, whether or when you can sue a former client without violating ABA Model Rule 1.9(a). By a strange coincidence, this issue was the subject of rulings this spring from the Supreme Courts of Colorado and Washington that have diametrically different results. 

 

Here to navigate us through the shoal waters of ethics and conflicts are John Bonnie, Weinberg Wheeler Hudgins Gunn & Dial, and Neil Posner, Much Shelist, P.C., the chairs of the ACCC Professionalism and Ethics Committee, who will be join by Sherman & Howard LLC's Chris Mosley, who argued the Colorado case, Persichette v. Owners Ins. Co., 462 P.3d 581 (Colo. 2020). Neil and John are the authors of an insightful article on this issue in the latest ACCC newsletter, which you might want to read before this call.
