An ACCC Dialogue: Will Legislatures Mandate BI Coverage for Covid-19 losses?

Even as the number of law suits and proposed class actions seeking business interruption coverage continues to grow, eight state legislatures are now considering proposals to retroactively mandate BI coverage for the Covid-19 pandemic.  While these bills all share a common declaration of retroactivity, they differ with respect to which policies are covered, how small the insured must be to qualify, whether insurers may qualify for reimbursement for a state fund through surcharges on all P/C companies and whether their applicability extends to future pandemics.   Additionally, the U.S. House of Representatives is now considering two proposals that would establish a voluntary market for pandemic coverage with a reinsurance backstop much like TRIA and one that would mandate retrospective and involuntary coverage.  Do these bills have a chance of passage?  Is retroactively mandating coverage constitutional?  If enacted, how will these bills affect pending litigation or reinsurance cessions?
