ACCC Pop-Up Dialogue: Too Many Claimants, Too Little Money: Difficult Options

When an insurer is presented with multiple claims arising out of a single accident, the value of any one or all of which may exceed the policy limits, the insurer faces difficult choices. Historically, insurers have considered interpleader to be a reliable means of avoiding potential extracontractual liability for failing to settle in these cases. In 2024, however, an Indiana case, Baldwin v. Standard Fire Insurance Co., called that strategy into question. So, how should lawyers for insurers advise their clients in these situations? What advice should defense lawyers give insureds when the liability limits of their policies are inadequate to fully protect them? Join us as we try to reach the “most right” answers to these questions.
