ACCC Pop-Up Dialogue: Insurance Policy Construction Methods & The Use of Linguistics
Policy construction is often at the heart of coverage disputes. This pop-up will review different methods of insurance policy construction, focusing on questions about defining risks to be insured against and then looking at policy language that seeks to implement that definition, and the consequences of construction methods employed by courts across the country on the predictability of results. This will include some discussion of the use of linguistics and LLM’s to construe policies, and the success (or lack thereof) that advocates have had in presenting those arguments to courts.
