ACCC Pop-Up Dialogue - Picking Pocket of Third Parties: Impacts of Truck Insurance Exchange v. Kaiser Gypsum Co. and Purdue Pharma on Insurance Disputes

In this ACCC pop-up, we address the impacts of two recent Supreme Court decisions on insurance issues in bankruptcies:  Truck Insurance Exchange v. Kaiser Gypsum Co. and Purdue Pharma.  Truck holds that financially interested insurers have standing to object their insured’s Chapter 11 plan.  Purdue Pharma prohibits releases of third-party affiliates of the insured in non-asbestos bankruptcies. In this pop-up, we address how these two decisions will impact mass tort claims whose insureds are, or may become, insolvent. We will address the impact on existing and future liquidation and reorganization plans and how these decisions change the negotiating playing field for insureds and insurers as they navigate resolutions of mass tort claims.
