ACCC Pop Up Dialogue - Pollution Exclusion Cases Certified to the Hawaii and Alaska Supreme Courts
Courts are actively considering whether insurance coverage is available to address claims related to climate change. In echoes of the 1980s, pollution exclusions are the focus of two decisions that have recently been in the news. The panel will discuss their perspectives on two new pollution exclusion cases recently certified, respectively, to the Hawaii and Alaska Supreme Courts: Aloha Petroleum v. National Union, which addresses whether greenhouse gases are “pollutants” for purposes of applying a CGL pollution exclusion to a climate change lawsuit against a fossil fuel company, and Wheeler v. Garrison Property & Casualty Co., which addresses whether indoor carbon monoxide is a “pollutant” for purposes of applying a homeowners’ liability insurance pollution exclusion to a wrongful death lawsuit against a property owner.
