ACCC Pop-Up Dialogue: Use of AI in Coverage Opinion and Coverage Litigation and Use by Experienced and Junior Lawyers

Our August panel on the use of Artificial Intelligence discussed the potential uses and limitations of AI within an insurance coverage practice.

This month's Panel discusses some of the risks associated with AI use for both coverage analysis and litigation. For example, courts have noticed and sanctioned both attorneys and experts for undisclosed AI use or for various types of hallucinations, including by affiliated counsel. AI use (or non-use) also has potential implications for professional liability insurance and malpractice claims against law firms. Clients may demand AI use as part of their quest for efficient representation but may not be forgiving of AI-generated issues that are not noticed or corrected by their counsel. Our presenters will discuss those risks and some potential ways to mitigate them.
