ACCC Pop-Up Dialogue - The Texas Supreme Court Draws the Line on Appraisal
Appraisal clauses in Texas property insurance policies have generated years of litigation over a deceptively simple question: when the parties disagree, do they have to go to appraisal? On May 8, 2026, the Supreme Court of Texas provided its clearest answer yet. In in re ACE American Insurance Company, the Court granted mandamus relief compelling appraisal of a water-loss claim at a Dallas food-distribution warehouse, holding that potential coverage disputes do not defeat a contractual right to appraisal and that alleged insurer bad faith during adjustment does not excuse an insured from complying with an appraisal provision.
