Mind the Gaps, Please! - Will That Cyber Policy Cover Your Needs?
- John BuchananCovington & Burling LLP
Judith Selby, Tittmann Weix
- Timothy ZeilmanHSB & University of Connecticut School of Law
Cyber policy forms are still far from standardized. Each cyber insurer’s wordings warrant close study to avoid gaps in protection for specific operations and risks. Particularly for catastrophic losses, recent coverage restrictions for systemic risks and widespread events may present thorny coverage issues in today’s interconnected digital economy. AI use - by both insureds and threat actors - warrants careful coordination of cyber, tech E&O, and crime coverages. And for disastrous cyber-physical losses - old-school physical harms arising from new-fangled digital perils - an off-the-shelf cyber policy may exclude bodily injury and property damage, while policies that traditionally covered physical harm may now contain cyber-related exclusions. Tread carefully!

- Laura Hanson, Meagher & Geer, PLLP, Moderator
Insurance is a critical part of how the world works. Individuals and businesses determine their risk and attempt to “cover” it by the purchase of insurance. Insurance policies are contracts. Claims occur, and insureds submit them to their insurers for payment. Disputes can arise, of course, and that leads to litigation. There are lawyers involved in all these aspects of the process. This panel will feature lawyers and Judges with experience in the private practice of law and “in-house” counsel for an insurer. They will discuss their career trajectories and describe what they do in their day-to-day practice of insurance law.

1:20 - 2:20 pm   D&O/E&O Coverage for a Cyber Event
- Emily Garrison, Morgan
, Lewis & Bockius LLP
- Peter A. HalprinHaynes and Boone, LLP
-
Michael MenapaceWiggin and Dana LLP
- Peter Kochenburger, University of Connecticut
As cyber threats escalate in scale and sophistication, companies face mounting litigation and governance risks following a breach. Regulatory scrutiny, shareholder actions, and reputational fallout can expose directors and officers to personal liability. High-profile incidents have underscored the need for tailored D&O insurance to address risks tied to securities claims, regulatory investigations, and failures in cyber oversight.

- John Bonnie

-
Sherilyn Pastor, McCarter & English

- Tracy Alan Saxe, Saxe Doernberger & Vita, P.C., Moderator
Lawyers are important providers of legal services when natural disasters and other perils wreak havoc on the lives of individuals and their communities.  But lawyers can just as easily be harmed by the same unfortunate events. This panel will examine the lawyer as victim of a disaster event, facing not just the expected personal challenges and consequences, but also having to meet ongoing ethical obligations to clients, the courts and the profession. We will discuss the Model Rules of Professional Conduct applicable even in the worst of times, and survey the case law involving lawyer conduct in the wake of disaster-level events that resulted in disciplinary actions by ethics regulators.

3:35 - 3:45 pm   Wrap-Up and Closing Remarks
- Stephen PateCozen O’Connor & ACCC President
3:45 - 4:45 pm    William F. Starr Hall Reading Room, 2nd Fl.
